Beauty Divine Clinic – The Skincare Club Terms and Conditions

Membership is subject to Beauty Divine Clinic – The Skincare Club terms and conditions. Please send a copy of this to yourself or print out for your records. 

‘Beauty Divine Clinic’ MEMBERSHIP AGREEMENT Terms 

  1. ‘The Company’ is Beauty Divine Clinic also referred to in the agreement as ‘BDC’, ‘we’ and ‘us’. 
  2. If you have purchased club membership for yourself, you are referred to in the agreement as ‘you’ or ‘the member’. 
  3. If you have purchased club membership as a gift, terms relating to payment are applicable to the purchaser. Terms relating to membership and services are applicable to the member who is referred to as ‘you’ or ‘the member’. 

General 

  1. You should print a copy of this Agreement for future reference and a copy will be emailed to you following purchase. 
  2. The membership agreement is of 12 months duration (subject to terms under the heading “Cancellation”). 
  3. If any of the terms of this Agreement are invalid, unenforceable or illegal the remaining terms can still be enforced. 
  4. We may make reasonable changes to the Membership Agreement terms and conditions at any time. 
  5. We will send you email confirmation of these terms using the email address you used when you joined. 
  6. Membership is open to all customers over the age of 18. 
  7. Beauty Divine Clinic reserves the right to restrict the number of memberships available at each tier or across the whole Club without notice or explanation. 
  8. Additional services and products over and above your annual entitlement will be charged at the current tariff or list price and do not form part of this agreement. 
  9. You may upgrade any service included in your entitlement by paying the difference between your included entitlement and the current tariff or list price for the relevant service. 
  10. Your products included will be drawn from those brands and lines normally stocked in the salon. 
  11. Included products are of regular retail size and will be those recommended as necessary by us. 

Force Majeure 

  1. A Force Majeure Event is defined as an event beyond the reasonable control of Beauty Divine Clinic. These could include but are not limited to industrial disputes (whether involving BBR or any other party), failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors. 
  2. We shall not be liable to you as a result of any failure to perform our obligations under this agreement as a result of a Force Majeure Event. 

Membership 

  1. Membership packages we offer: Our membership package details are set out in the appendix and include information about what is included in the membership packages. 
  2. Your membership package: When joining, you will be asked to select a membership package (membership type), and your welcome email will confirm which package you selected. 
  3. Your membership starts straightaway: Your membership starts from when we inform you that you have completed the joining process.
  4. Your membership package choice is flexible: You can change to another membership package anytime during your membership period to a higher Tier Membership, any downgrades are subject to our agreement on the same. 
  5. The benefits you are entitled to: During your membership, you are entitled to enjoy the benefits set out in your membership package in accordance with these Terms, so long as you have paid your membership fees when due and are complying with these Terms.
  6. Other benefits are discretionary: If we make any benefits, offers or promotions available to you as a member in addition to your membership package, these are discretionary and can be withdrawn at any time unless we expressly tell you otherwise. 
  7. Only for you: Only you, the person named in the joining process, can benefit from the membership package and these Terms. You may not use your membership to obtain appointments/products or other benefits for anyone else. 
  8. Be good, please! Membership is not transferable and entitlement to inclusive services and products is restricted to the Member. You may not sell or make any commercial use of the products/discounts or other benefits obtained using your membership, and any attempt to do so will invalidate the membership or benefits thereof. 
  9. No show: If you have booked an appointment as a part of your membership and can no longer attend, you must cancel your appointment with a minimum notice of 48 hours. Any cancellations post that will be considered as a session attended unless expressly agreed by us in goodwill but under no obligation.

Your Membership Fees

  1. The membership fee will be as indicated in the joining process. 
  2. Payments are due monthly and will be collected via direct debit or online methods on the same date every month you set up your payment. You agree to maintain the payment for the amount due. Please contact us if you wish to cancel/change your payment. 
  3. If payment fails when due, Beauty Divine Clinic will write or email to advise you of this, you must remedy this situation and provide valid payment within 7 working days. 
  4. If you cancel your payment instruction and have received treatments that exceeds the total value paid you will be invoiced and required to make immediate payment for the difference outlined. 
  5. Should the Clinic be obliged to institute legal proceedings against the Member arising from breach of the terms of this Membership Agreement, including but in no way limited to their failure to pay any amount due by the due date, the Member acknowledges that they shall be liable for all tracing fees, collection commission and legal costs as may be allowed by the Court. 
  6. The Clinic may disclose personal particulars contained in the Membership Agreement to a credit reference agency or any other party necessary in obtaining settlement of arrears. 
  7. Payments by installments are due regardless of your usage or missed appointments. In the event of a payment default use of services will be denied until the shortfall has been made up. 
  8. You are responsible for making your appointments in time and regularly based on availability with Beauty Divine Clinic to ensure you avail your membership.

Cancellation 

  1. You have the option to cancel your membership without providing a specific reason. To initiate the cancellation process, notify us through the same contact method(s) you use for scheduling appointments.
  2. For a successful termination, please submit your notice before the 15th of the month, ensuring a 30-day notice period for the following month’s cancellation. Your next payment collection will cease within 30 days of your termination notice. The membership concludes on the paid-up date; for instance, if you terminate on the 15th of November, the final payment covers the month of December, with subsequent payments paused.
  3. If you’ve utilized any services or products until the cancellation date, you are required to settle the difference between your monthly membership payment and the total tariff or list price of the received products and services.
  4. Notably, this is not a credit agreement, and you retain the flexibility to cancel your membership at any time. However, carry forwards or rollovers for missed appointments or months are not permitted, except at the discretion of Beauty Divine Clinic.
  5. We hold the authority to cancel your membership without notice or providing a reason. Past membership fees are non-refundable, but if you haven’t benefited from any services or products in the current month, a refund for that month’s fee will be processed.
  6. In cases where we terminate your membership due to the abuse of Club benefits, real or perceived, you will be charged for the variance between the membership fees paid and the total price list for the enjoyed services.

Automatic Renewal 

  1. You will be contacted by email before the expiration of current membership, detailing the ruling rate at which membership can be renewed. In the event a level of membership is discontinued we will renew your membership on the closest equivalent level. 
  2. In case of dispute the onus is on you to show that you terminated membership in accordance with these terms. 

Communications

  1. We may send you information relating to your membership, Beauty Divine Clinic and current offers and promotions by email, SMS or by post. 
  2. You may opt out of email and SMS communications that we may send but if you do we cannot be held responsible for any loss incurred by you not receiving relevant communications. 
  3. Communications posted (either with or without proof of posting) will be assumed to be received. 
  4. Emails will be assumed to be received and read.
